Apex provides AI-powered communication and automation services that may include (but are not limited to) AI assistants, lead follow-up automation, appointment scheduling support, analytics, and integrations with third-party tools such as CRMs, calendars, email, SMS, and chat platforms.
3) Description of SMS Program & Messaging Use Cases
If you opt in to receive SMS/text messages from Apex (or an Apex-managed messaging program), messages may be sent for operational and support purposes, including:
- Appointment reminders (e.g., confirmations, reschedules, cancellations).
- Follow-up messages (e.g., post-appointment check-ins, requested next steps, and support-related follow-ups).
4) Instructions to Opt-Out of SMS
You can opt out of SMS at any time by replying STOP to any message (i.e., Text STOP to any message). After you opt out, you may receive a final confirmation message and then no further SMS messages will be sent unless you opt in again.

10) Disclaimers
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. AI systems can be probabilistic and may produce inaccurate or unexpected results. You are responsible for reviewing outputs before relying on them.
11) Limitation of Liability
To the maximum extent permitted by law, Apex will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption arising out of or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages.
To the extent permitted by law, Apex’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to Apex for the Services in the three (3) months immediately preceding the event giving rise to the claim.

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
